TERMS & CONDITIONS

Etheridge Forestry Mulching LLC

These Terms & Conditions govern all services, products, equipment, and transactions involving Etheridge Forestry Mulching LLC (“Company”, “we”, “our”, or “us”).

By purchasing products, scheduling services, approving estimates, submitting payment, possessing equipment sold by the Company, or using the Etheridge Recovery Adapter™, the purchaser, client, or operator (“Customer”, “User”, or “Operator”) agrees to these Terms & Conditions.

These Terms apply to all services and products provided by Etheridge Forestry Mulching LLC.


PART I

SERVICE TERMS & CONDITIONS

(Forestry Mulching Services)

These terms apply to all land clearing, forestry mulching, vegetation clearing, and related services performed by Etheridge Forestry Mulching LLC.


1 — Booking & Payment

Payment may be required at the time of booking to reserve a project date.

Remaining balances are due immediately upon completion of services unless otherwise agreed in writing.

Accepted payment methods may include:

• cash
• debit card
• credit card
• electronic payment services
• other approved payment methods.

Failure to remit payment may result in:

• late payment fees
• suspension of services
• collection actions
• recovery of legal costs.


2 — Travel & Service Area

Etheridge Forestry Mulching LLC operates primarily throughout Georgia and Alabama.

Our standard operating radius includes properties within 20 miles of our operating location.

Projects outside this area may incur travel charges.

Travel and equipment transportation may be billed at:

$2.50 per mile (round trip).


3 — Scheduling Adjustments

Project schedules are determined based on:

• equipment availability
• weather conditions
• travel logistics
• previous project delays.

Scheduled service times may require adjustment due to these factors.

Minor scheduling adjustments do not constitute a breach of agreement.


4 — Property Access

The Client must ensure the property is accessible at the scheduled service time.

This includes:

• unlocked gates
• clear access roads
• removal of obstacles.

If the Company cannot access the property due to conditions outside our control, the Client may be charged:

• travel costs
• mobilization costs
• equipment standby time.


5 — Client Responsibilities

The Client is responsible for:

• identifying property boundaries
• marking underground utilities
• removing personal property from work areas
• securing animals and livestock.

Clients are encouraged to contact 811 utility locating services before work begins.

The Company is not responsible for damage to unmarked utilities.


6 — Hidden Hazards

Equipment may be damaged by hidden obstacles including:

• steel posts
• buried fencing
• large rocks
• metal debris
• construction materials.

Damage caused by undisclosed hazards may result in repair costs billed to the Client.


7 — Forestry Mulching Results

Forestry mulching results depend on:

• vegetation density
• terrain conditions
• soil composition
• hidden debris.

The Company does not guarantee specific acreage clearing results within a given timeframe.


8 — Photo & Media Release

The Company may photograph or record the project site before, during, and after services are performed.

Photos or videos may be used for:

• marketing
• advertising
• social media
• website promotion.

While reasonable efforts will be made to avoid publishing personally identifiable information, complete redaction may not always be possible.


9 — Limitation of Liability (Services)

To the maximum extent permitted by law, Etheridge Forestry Mulching LLC shall not be liable for:

• hidden hazards
• incidental property damage
• weather delays
• dissatisfaction with project outcomes.

Total liability shall not exceed the amount paid for services.


PART II

PRODUCT TERMS & CONDITIONS

(Etheridge Recovery Adapter™ and Equipment Sales)

These terms apply to all products sold by Etheridge Forestry Mulching LLC including the Etheridge Recovery Adapter™.


10 — Product Description

The Etheridge Recovery Adapter™ is a portable anchored winch mounting and recovery positioning device designed to allow winch systems to operate from structurally capable anchor points when direct vehicle alignment is not possible.

The current model supports pulling forces up to 15,000 pounds when used properly.

Future models may support higher load tolerances.


11 — Required Equipment

The Etheridge Recovery Adapter™ must be used with appropriate recovery equipment including:

• winch plate mount
• properly rated winch
• electrical power supply or jumper cables
• rated shackles, chains, or straps
• structurally capable anchor points.

Improper equipment may cause injury or equipment failure.


12 — Anchor Point Responsibility

Users are solely responsible for selecting anchor points capable of supporting the intended load.

Examples may include:

• large trees
• structural steel
• heavy equipment
• engineered ground anchors.

The Company does not guarantee anchor point strength.


13 — Load Limits

Users must never exceed:

• winch capacity
• adapter rating
• anchor strength
• rigging component ratings.

The lowest rated component determines the maximum safe load.


14 — Assumption of Risk

Vehicle recovery operations involve inherent risks including:

• cable recoil
• anchor failure
• vehicle movement
• equipment damage
• serious injury or death.

Users voluntarily assume all risks associated with recovery operations.


15 — Waiver & Release of Liability

To the fullest extent permitted by law, users waive any claims against Etheridge Forestry Mulching LLC arising from the use or misuse of the Etheridge Recovery Adapter™.


16 — Product Misuse

The Company is not responsible for damages resulting from:

• improper installation
• unsafe rigging practices
• exceeding rated load limits
• failure to follow safe winching procedures.


17 — Product Modification

The Etheridge Recovery Adapter™ must not be modified, drilled, welded, or altered.

Unauthorized modifications void liability protections.


18 — Returns

Unused products may be returned within 30 days if:

• unused
• undamaged
• in original condition.

Used equipment is not eligible for return.


19 — Warranty Disclaimer

All products are sold “AS IS.”

The Company makes no warranties including merchantability or fitness for a particular purpose.


20 — Government & Military Use

Products may be used by:

• private individuals
• contractors
• government agencies
• military organizations.

All users assume responsibility for safe operation.


21 — Intellectual Property

The Etheridge Recovery Adapter™ is Utility & Design Patent Pending.

Unauthorized reproduction or manufacturing may violate intellectual property law.


PART III

SAFETY & RISK NOTICE

Vehicle recovery operations involve extreme forces.

Improper use of recovery equipment may cause:

• serious injury
• death
• property damage
• equipment failure.

Users must follow accepted recovery safety practices including:

• using rated equipment
• maintaining safe distances from cables under tension
• inspecting equipment before each use
• selecting structurally capable anchor points.

Failure to follow safe operating procedures constitutes misuse of the product.

Etheridge Forestry Mulching LLC shall not be responsible for damages resulting from unsafe operation.


PART IV

LEGAL PROVISIONS


22 — Chargebacks

Customers agree to contact the Company before initiating payment disputes.


23 — Arbitration

Any disputes shall be resolved through binding arbitration.


24 — Class Action Waiver

Customers agree disputes will not be brought as class actions.


25 — Governing Law

These Terms are governed by the laws of the State of Georgia.

Venue shall occur in Houston County, Georgia.


26 — Severability

If any provision of these Terms is determined unenforceable, remaining provisions remain valid.


27 — Agreement Acceptance

By purchasing products or scheduling services with Etheridge Forestry Mulching LLC, the Customer acknowledges they have read and agreed to these Terms & Conditions.
